Tuesday 5 March 2024 Port-link Industrial Park updateAn Independent Commissioner has granted the resource consent for Port-link Industrial Park as a non-notified application. A copy of the resource consent decision is available here. As mentioned in our previous update, in 2022 a resource consent application was lodged for the overall operation at the site and a boundary adjustment subdivision. The Council initially recommended public notification of the application. However, an amended application was lodged for departing from some rules for the industrial activity at the site. This included changes to landscaping, setbacks, noise, and ecology matters. This amended application was considered by an Independent Planning commissioner who made the decision to process the application as a non-notified application and to grant resource consent with conditions, which include landscaping and maintenance requirements, noise restrictions and maximum heights of containers. Appeal rightsThe applicant has lodged an objection under the Resource Management Act to the conditions imposed under the resource consent. The objection will be considered by an independent commissioner. The applicant has also appealed the decisions to decline the certificates of compliance and to issue an abatement notice that requires the applicant to comply with District Plan Rules as they relate to building height in the zone. The applicant has applied to the Environment Court for an Order that the abatement notice not be enforced until after the appeals are decided by the Court.
