Today, House Bill 1549 was presented to the Governor for signature. House Bill 1549 would eliminate the diligent effort requirement for agents placing surplus lines insurance in Florida. The bill also adds additional language to the disclosure form that must be signed by the insured before placement with a surplus lines carrier. The disclosure form will now include the language, “surplus lines insurers' policy rates and forms are not approved by any Florida regulatory agency.” FSLSO will update this information on all forms provided the bill is signed.
Under Florida law, the bill must be signed—or go unsigned without veto for 7 days after presentation to the Governor—to become law. The bill includes an effective date of July 1, 2025.
