Winter has well and truly set in across the country and I hope you’re managing to keep warm. We have highlighted some tribunal decisions; I encourage you to have a read of these and take note of the learnings from them.

Report unregistered trading

Registered Traders are often well placed to identify and report those who are unlawfully trading. Once reported, the Registrar can take appropriate compliance action.

Decisions from the Motor Vehicle Disputes Tribunal

Two recent decisions made by the Motor Vehicle Disputes Tribunal relate to traders not complying with Consumer Guarantees Act. In both cases, the Tribunal ruled in the customer's favour and in one case the trader was ordered to pay and in the other the trader was required to repair the vehicle.

Changes to the act that regulates Clean Car Standard

The Land Transport (Clean Vehicle Standard) Amendment Act 2024, which passed last week, will make it possible for emissions targets to be adjusted more easily through regulation rather than through legislation, so that it can be more responsive to market conditions.

The changes also allow for the introduction of a user-pays model to cover the administration costs of running the Clean Car Standard.

A review of the Clean Car Standard is currently underway. We’ll keep you updated on any changes.

Change to the Motor Vehicle Dispute Tribunal Fees

The cost to make a claim to the Motor Vehicle Dispute Tribunal increased on the 1 July 2024 from $50 to $84.
