By a 6-3 vote, the Supreme Court ruled this week in Kennedy v. Bremerton School District that the district violated the Free Exercise and Free Speech Clauses by disciplining former Washington state high-school football coach, Joseph Kennedy, for taking a knee in quiet prayer on the 50-yard line. The ruling affirmed that Coach Kennedy had the constitutional right to engage in a personal religious observance in public, marking yet another historic Supreme Court decision this term.
On June 27, the U.S. Supreme Court denied a petition for a writ of certiorari in Coral Ridge Ministries Media, Inc. v. Southern Poverty Law Center, a case involving NRB member D. James Kennedy Ministries (also known as Coral Ridge Ministries Media, as named in court filings). “We view this as a missed opportunity to revisit the Times v.
Sullivan actual malice standard,” said NRB CEO Troy A. Miller. “We look forward to the day the Supreme Court reexamines that precedent and reconsiders the need for recourse against false, outrageous, and damaging allegations like those of the corrupt SPLC.”
