Regulators Agreed Positions and Technical Interpretations - Version 6

 
 

This article applies to all four administrations

On Tuesday 15 April, regulators published Version 6 of the ‘Extended producer responsibility for packaging: Regulators’ agreed positions and technical interpretations’ on NPWD. 

Version 6 applies to The Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024. Below are some of the key updates, note that this list is not exhaustive; Appendix 10 provides a comprehensive summary of all updates. 

  • Further detail added for small producers. 
  • New and revised examples for improved clarity and to reflect regulatory changes.  
  • A clearer explanation of relevant years and how they interact with each other. 
  • New sections on 'When a person ceases to be a producer’ and ‘Small producers’.  
  • New appendices that include the Regulators’ position on mid-year changes, and a self-managed packaging waste flow diagram to help large producers identify their packaging waste as self-managed organisation waste, or self-managed consumer waste. 

It is important to note that Version 6 applies to 2025 obligations onwards. It does not replace Version 5.1, which applies to 2024 data reporting under the Packaging Waste (Data reporting) Regulations 2024 (as amended).

The Extended producer responsibility for packaging: Regulators’ agreed positions and technical interpretations provides more detailed guidance on complying with the EPR regulations. We would encourage producers with compliance questions to refer to this and to guidance on Gov.uk in the first instance, before contacting their relevant regulator with queries.
