Four years have passed since the enactment of the Cannabis Regulatory Enforcement Assistance and Marketplace Act. Since then what have we learned about an employer’s ability to test for cannabis use? Fentanyl will soon be one of the substances truckers will be tested for during DOT drug screenings. The large majority of Fortune 500 companies still drug-test prospective employees, according to a new analysis, discriminating in their hiring processes against people who use substances that include legally obtained cannabis. An explosion on the job that killed and injured people prompted a Florida employer to seek drug and alcohol testing for blood drawn from a worker involved in the incident when he received treatment at the hospital, but a lack of reasonable suspicion to test defeated the employer's case.
