With the rapidly evolving effect of executive orders from the White House, PBPA has set up a new page on our website – Nonprofits and the New Administration. On this page, you'll find links to resources that help explain the latest developments and their potential impact on your organization.

One of the issues creating uncertainty in the nonprofit sector lately is the new administration’s actions around DEI ("Diversity, Equity, and Inclusion"). While a federal court recently granted a preliminary injunction related to the DEI Executive Orders, the administration has appealed and gives no indication of changing course.  In the meantime, nonprofits should educate themselves on the executive actions targeting DEI and review their DEI programming. What exactly qualifies as DEI? What might make a DEI program or policy “unlawful”? What if we are required to sign a DEI certification for our government contract? This article from Morrison & Foerster offers insightful analysis and practical advice to help nonprofits navigate the potential effects of recent government initiatives, along with tips for evaluating DEI programming.

One of the greatest challenges a nonprofit board of directors can face is managing conflict with and potentially terminating an executive director. While no board wants to find itself in this situation, it's crucial to be prepared. In this episode of the PBPA podcast, Alex Drummond with Seyfarth Shaw and Lori Shapiro with Pro Bono Partnership of Atlanta discuss how boards can navigate conflicts with their executive director and what steps to take if termination becomes necessary. We'll cover key tips and legal considerations to ensure fairness to the executive director, maintain oversight of the nonprofit, and prepare the board members themselves.

How to Structure Healthcare Stipends for Employees

Nonprofits devote their operating funds to supporting their mission. Nonprofit leaders also want to support the well-being of the employees who make their mission possible by providing healthcare-related benefits. It is important to structure benefits in a tax compliant manner, and it is no surprise that tax law can be complex.

In this webcast, we will provide an overview of the different strategies to provide healthcare-related benefits outside of traditional employer-provided health insurance. These strategies can include healthcare stipends, ICHRAs, and QSEHRAs. We will also touch on ACA compliance.
