A slip and fall accident may seem like a minor concern or something that could never happen at your facility. Legal claims associated with slip and falls, generally called “premises liability”, may be more common than you realize and can lead to serious injuries, costly legal battles, and significant disruptions to your organization’s mission. In this episode of the PBPA Podcast, Kendra Talley and Holly Hempel with Nelson Mullins will talk about strategies to mitigate slip and fall risks at your nonprofit facility. Does your nonprofit host auctions with a live auctioneer? Nonprofits that engage in live auctions should be aware of the Georgia Auctioneers Law (the “GAL”). The GAL requires organizations that conduct live auctions to use a licensed auctioneer, with limited exceptions.  Read this article, to understand whether your nonprofit’s auctions might be exempt or if they are subject to GAL’s license auctioneer requirements.

Before signing a contract, always read the entire document.  Even if you can’t negotiate any changes to it, at least you’ll know what you’re signing up for!  If you’re unable to read the entire contract, prioritize the termination clause. Consider this real-life example of a vendor contract with this provision: Either party may terminate this Agreement for any reason with 60 days’ notice.  Sounds good, right?  But later in the contract, a provision stated that the nonprofit was liable for the full monthly charges of the contract term. In other words, while the nonprofit could end the agreement, they were still on the hook financially. Avoid this!  Read the entire termination clause of your contracts before signing (or clicking through).

Fundraising Compliance: Understanding Charitable Solicitation Requirements

In addition to registering for tax-exempt status with the IRS and forming your corporation with the state, did you know that your charity should register for “charitable solicitation?” Nonprofits have significant obligations to register in states where they ask for money. These rules can be traps for the unwary. During this one hour webinar, our speakers help nonprofits understand who needs to register to solicit donations and how to determine where (which states) to register.
