Restraint of trade

Training repayment or restraint of trade?

A recent Court of Appeal decision found a training repayment clause unenforceable as a restraint of trade. Employers should review clawback provisions to ensure they are proportionate, justifiable and linked to genuine training costs. The judgment offers important guidance on training repayment arrangements.

Preventing sexual harassment and third-party harassment

Employers already have a duty to prevent sexual harassment but from 30 October 2026, employers will be required to take all reasonable steps to prevent sexual harassment in the workplace. Employers will also become liable for third-party harassment. We can provide tailored support and training to help you comply with your obligations and reduce the risk of claims.
