There haven’t been many more polarizing issues than the legalization of marijuana in New Jersey. For the past 50 years, federal law has prohibited the use, cultivation, and distribution of cannabis. The Pennsylvania Medical Marijuana Act (“MMA”) contains an anti-discrimination provision, that prohibits employers from discriminating against an employee “solely on the basis of such employee’s status as an individual who is certified to use medical marijuana.” Drug use is not inherently an issue, but misuse and addiction are conditions that are cause for concern.
