MUST READ: Walmart Wins Lawsuit Over Marijuana Use in New Jersey On May 26, 2023, Walmart emerged victorious in a lawsuit filed by Erick Zanetich under the New Jersey Cannabis Regulatory, Enforcement Assistance and Marketplace Modernization Act (CREAMMA). Employers are discovering more marijuana use in drug tests after workplace accidents, according to new research from Quest Diagnostics. As more states legalize marijuana and competition for talent grows fiercer, the U.S. government is loosening guidelines from the “Just Say No” era. As of May 1, 2023, marijuana had been legalized for medicinal or recreational use, or both, in thirty-eight states. Manufacturing employers still may prohibit the use of marijuana at work, as well as marijuana impairment at work. But marijuana drug testing is complicated and controversial because of the legal protections for off-duty marijuana use. With the legalization of marijuana, workplaces in Delaware will now have to contend with the increased usage that will bring. In response to the bills, the state of Delaware implemented a new policy for all executive branches to ban smoking or being under the influence of marijuana, similar to the use of alcohol.
